DIBS Terms of Service

1. Agreement to Terms and Release of Liability

1.1 Assumption of Risk and Release

By accessing or using DIBS ("Platform", "we", "us", "our"), you agree to be bound by these Terms of Service.

Users (both Hosts and Parkers) expressly acknowledge and agree:

a) THE PLATFORM CARRIES INSURANCE COVERING:

  • Property damage caused by Parkers to Host property
  • Bodily injury occurring on the parking premises
  • Medical expenses up to $10,000 per person

b) THE PLATFORM'S INSURANCE DOES NOT COVER:

  • Damage to parked vehicles
  • Theft or loss of vehicle contents
  • Vehicle-to-vehicle accidents or collisions
  • Personal property left in vehicles
  • Vehicle mechanical issues or breakdowns
  • Pre-existing damage to Host property
  • Incidents occurring outside the reserved parking space
  • Incidents occurring outside the reserved parking time

c) ASSUMPTION OF RISK: By using the Platform, you voluntarily assume ALL RISKS associated with using the service, including but not limited to all risks not covered by the Platform's insurance as outlined above. You acknowledge that parking involves inherent risks to property and person, and you willingly accept these risks.

Users are strongly advised to maintain their own appropriate insurance coverage for all uncovered risks.

1.2 Indemnification

Users agree to indemnify and hold harmless DIBS and its officers, directors, employees, agents, subsidiaries, affiliates, successors, and assigns from any claims, losses, damages, liabilities, costs and expenses (including reasonable attorneys' fees), arising out of or related to:

  • User's violation of these Terms
  • User's use of the Platform
  • User's parking space listings or bookings
  • Any interaction between Hosts and Parkers
  • Any property damage or personal injury
  • Any violation of law or third-party rights

1.3 Insurance Claims Process

In the event of a covered incident:

  • Report the incident immediately through the Platform
  • Document with photos and written description
  • Collect contact information of all involved parties
  • DIBS will provide insurance claim forms within 72 hours
  • Claims must be submitted within 72 hours of incident

For medical expenses claims:

  • Up to $10,000 available per person
  • Must be reported within 24 hours
  • Requires medical documentation

2. Definitions

2.1 Platform Terms

  • "Event Parking" means temporary parking spaces near event venues
  • "Host" means individuals/entities offering parking spaces
  • "Parker" means individuals booking parking spaces
  • "Listing" means a parking space offered on the Platform
  • "Booking" means a confirmed reservation of a parking space

3. Platform Services

3.1 Service Description

DIBS provides a marketplace connecting Hosts with Parkers for event parking. We do not own, control, or manage any parking spaces.

3.2 Platform Role

  • Facilitate connections between Hosts and Parkers
  • Process payments
  • Provide support services
  • Maintain platform infrastructure
  • NOT responsible for parking space quality/condition

4. User Accounts

4.1 Registration Requirements

  • Must be 18 or older
  • Valid email or phone
  • Accurate profile information
  • Secure password maintenance
  • One account per user

4.2 Account Responsibilities

  • Maintain accurate information
  • Protect account credentials
  • Report unauthorized access
  • Comply with all policies
  • Accept communications from DIBS

5. Host Terms

5.1 Listing Requirements

  • List up to 30 days before event
  • Accurate space description/photos
  • Truthful vehicle capacity
  • Clear access instructions
  • Available during reservation hours

5.2 Host Obligations

  • Honor confirmed bookings
  • Maintain described conditions
  • Available for contact
  • Follow cancellation policies
  • Report issues promptly
  • Maintain safe parking conditions
  • Clear hazards from parking area
  • Provide adequate lighting if offering night parking
  • Mark any dangerous conditions
  • Report unsafe conditions to DIBS
  • Maintain documentation of parking area condition

5.3 Host Payments

  • Payouts up to 72h after event completion
  • 14-day transfer windows
  • Subject to platform fees
  • Penalty deductions if applicable

6. Parker Terms

6.1 Booking Terms

  • Full payment at reservation
  • Arrive within booking window
  • Follow parking instructions
  • Vacate on time
  • Report issues promptly

6.2 Parker Obligations

  • Provide accurate vehicle information
  • Update vehicle information as needed prior to reservation start time
  • Respect Host property
  • No transferring of parking spot to another user
  • Follow overstay policies
  • Accept authorized towing risk for violations of terms

7. Payments and Fees

7.1 Payment Structure

Full payment required at booking Service fees included in total Payment methods accepted:

  • Credit/debit cards
  • Digital wallets
  • Other approved methods

7.2 Host Payouts

  • Released up to 72 hours after event completion
  • 14-day transfer window
  • Available payout methods:
    • Bank transfer (ACH)
    • Other approved methods

7.3 Platform Fees

  • DIBS charges a 7.5% service fee to both Hosts and Parkers
  • This service fee covers all platform costs including payment processing, insurance, and other operational expenses
  • No additional fees are charged except for penalties as described in other sections

7.4 Cancellations & Refunds

Event Cancellations and Extenuating Circumstances DIBS will provide full refunds to Parkers in the following circumstances:

  • Event cancellation by the venue or organizer
  • Severe weather conditions making the event unsafe
  • National or local emergencies affecting the event
  • Other extenuating circumstances as determined by DIBS

In these cases:

  • Full refund processed automatically
  • Processing fees included in refund
  • Platform credits may be offered as additional compensation
  • Refund processed within 3-10 business days

Host Cancellations:

  • 3 days before the event: Warning + rating impact
  • 24-72 hours before the event: Warning + rating impact
  • <24 hours before the event: $15 penalty ($10 to parker, $5 to DIBS)
  • All guest refunds processed automatically

Parker Cancellations:

  • 48+ hours: Full refund
  • -48 hours: Partial refund
  • Day off: No refund
  • Processing fees non-refundable

7.5 Platform Credits

  • Issued for host cancellations
  • Valid for 6 months
  • Non-transferable
  • Non-refundable

8. Prohibited Activities

  • False information
  • Unauthorized access
  • Circumventing fees
  • Discriminatory behavior
  • Off-platform transactions
  • Harassment/abuse
  • Illegal activities

9. Overstay Policies

9.1 Time Limits

  • 1-hour grace period
  • Penalties after grace period
  • Maximum 5-hour penalty period
  • Towing authorization conditions

9.2 Penalties

  • $10/hour after grace period
  • Maximum $25 penalty
  • Towing at parker's expense
  • Platform credit system

10. Platform Rights

10.1 Account Actions

  • Suspension rights
  • Termination conditions
  • Fee adjustments
  • Feature modifications
  • Access restrictions

10.2 Content Rights

  • User content license
  • Marketing usage
  • Data analytics
  • Review systems
  • Rating policies

11. Dispute Resolution

11.1 Process

  • Users agree to attempt direct resolution of disputes before contacting DIBS
  • DIBS customer support may assist in resolving disputes between users
  • DIBS reserves the right to make final decisions on disputes related to platform usage
  • All decisions made by DIBS regarding refunds, penalties, or account actions are final

11.2 Insurance Claims

For insurance claims, users must:

  • Report incidents immediately through the Platform
  • Provide photos and documentation as requested
  • Submit all required information within 72 hours of the incident

11.3 Arbitration and Class Action Waiver

BY USING THE PLATFORM, YOU AGREE THAT ANY DISPUTE BETWEEN YOU AND DIBS THAT CANNOT BE RESOLVED INFORMALLY SHALL BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION CONDUCTED IN FLORIDA UNDER THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION. YOU UNDERSTAND THAT BY AGREEING TO THESE TERMS, YOU AND DIBS ARE EACH WAIVING THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

Small claims court cases are excluded from this arbitration requirement.

12. Intellectual Property

  • Platform ownership remains with DIBS
  • User content rights are licensed to DIBS
  • License limitations clearly defined
  • Trademark protection asserted
  • Copyright notices must be respected

13. Privacy and Data

Please refer to our Privacy Policy, which is incorporated by reference into these Terms of Service.

14. Modifications

  • Terms updates may occur periodically
  • Notice requirements for material changes
  • Continued use constitutes consent to updated terms
  • Material changes will be communicated via email or platform notification
  • User notifications will be sent at least 14 days before material changes take effect

15. Governing Law

  • Florida law governs these Terms
  • Miami-Dade jurisdiction for all disputes
  • Arbitration agreement as outlined in Section 11.4
  • Class action waiver as outlined in Section 11.5
  • Legal notices must be sent to our headquarters address

16. Insurance Summary

DIBS maintains a Commercial General Liability insurance policy with the following coverage:

  • $1,000,000 per occurrence
  • $2,000,000 general aggregate
  • $10,000 medical expenses coverage per person

What Our Insurance COVERS:

  • Property damage caused by Parkers to Host property
  • Bodily injury occurring on the parking premises
  • Medical expenses up to $10,000 per person for injuries sustained on parking premises

What Our Insurance Does NOT Cover:

  • Damage to parked vehicles
  • Theft or loss of vehicle contents
  • Vehicle-to-vehicle accidents or collisions
  • Personal property left in vehicles
  • Vehicle mechanical issues or breakdowns
  • Pre-existing damage to Host property
  • Incidents occurring outside the reserved parking space
  • Incidents occurring outside the reserved parking time

All users (both Hosts and Parkers) explicitly acknowledge and accept that they are SOLELY RESPONSIBLE for obtaining appropriate insurance coverage for all risks not covered by the Platform's insurance. By using DIBS, you acknowledge that you have been informed of these coverage limitations and agree to assume all risks not explicitly covered.
